1. Who provides Selv

These Terms govern the Selv macOS application and related services, provided by Louis Hein, trading as Selv · Switzerland ("we", "us"). By installing or using Selv, you agree to these Terms. If you do not agree, do not use the application.

Paddle is our authorised reseller and merchant of record for paid purchases. Your purchase is from the Paddle entity identified at checkout and on your receipt. Paddle's buyer terms govern the payment transaction; these Terms govern your use of Selv.

2. Eligibility and licence

You must be at least 16 to use Selv. If you are under 18, you need the consent of a parent or legal guardian.

Subject to these Terms, we grant you a non-exclusive, non-transferable licence to use Selv for your own personal or professional work, including commercial and client work. A paid licence is for one person and one active Mac at a time. You may move it to another Mac you own or control using the activation process.

You may not sell, sublicense or redistribute the application or your licence, remove proprietary notices, or reverse-engineer the application except where applicable law or a third-party open-source licence permits it. Your licence does not transfer ownership of Selv's software or branding.

3. Free

Free costs nothing and requires no payment card or Selv account. Capture is unmetered, subject to your storage and settings. Free makes the most recent 10 days of retained captured memory available for search, AI answers and export through Selv. Older captured memory remains on your device unless deleted under your settings; Free does not search, answer from or export that older memory.

Free includes 15 AI questions and 25 connected-agent retrievals per week. The current feature list and any introductory trial are described on the pricing page. A free trial does not create a payment obligation or automatically become a paid plan.

Free uses the same local data protection as Sovereign. We may change Free features with at least 30 days' notice to existing users.

4. Sovereign

Sovereign is a one-time purchase, currently €199. It is not a subscription: there are no recurring charges or automatic renewals. It grants a perpetual licence to the version available at purchase and all versions released within 180 days after purchase.

Sovereign makes your entire retained captured history available through Selv and includes unlimited local AI questions, standard models, multi-display capture, weekly reviews, supported connections and exports, and 150 connected-agent retrievals per week. The pricing page lists the included features. Optional third-party services may have their own charges, terms and availability.

Your licence does not expire when the update window ends. You can continue using a version covered by your licence. Later versions may be offered as a separate, optional purchase. A perpetual licence does not promise compatibility with every future operating system or perpetual availability of third-party services.

The purchase confirmation and licence email provide digital access and activation instructions after payment is confirmed. Initial activation and moving a licence between Macs require an internet connection. Local capture, search and chat can work offline after setup and model downloads.

5. Updates, availability and support

Updates are published for you to download and install; Selv does not silently install a new application version. Free updates are provided at our discretion. Sovereign update eligibility is described above.

Documentation, the in-app guide and email support are available on both plans. Planned features are not part of a purchase unless explicitly included in the offer at checkout. If we discontinue Selv, we will give at least 90 days' notice; discontinuation does not end your right to use an already licensed version.

6. Price, payment and refunds

Website prices are in euros and include VAT where it applies. Paddle shows the final total and any currency conversion before you confirm payment, handles applicable transaction taxes and issues your payment receipt. We do not receive or store your full payment card details. Price changes apply to future purchases and do not add charges to an existing Sovereign licence.

You may request a full refund within 30 days of purchase, for any reason or none. There are no usage conditions and no deductions. Email support@selv.io or use Paddle's buyer support. Downloading or activating Selv does not remove this promise.

After a refund, the Sovereign licence is no longer valid. You must deactivate the refunded licence; you may continue using Free. An offline installation may not learn of the refund automatically. A refund does not delete your local data or files you have already exported. This promise is additional to your mandatory consumer rights and any rights under Paddle's terms.

7. Your content and privacy

You retain your rights in your notes, recordings and other content. You are responsible for having the right to capture, import and use that content, including any consent required when recording other people or handling client or workplace information.

Selv's on-device features process your personal memory locally. Enabling external connections, using third-party AI tools or choosing an external backup destination can share data with the service you choose. Our Privacy Policy explains local processing, optional sharing, licensing records and website data.

8. Acceptable use and AI output

Do not use Selv to break the law, infringe another person's rights, gain unauthorised access to data, or disrupt systems or services.

AI-generated answers and summaries can contain mistakes or omit context. Check the original source before relying on an answer. Selv is a memory and note-taking tool; it does not provide medical advice, diagnosis or treatment.

9. Intellectual property

Selv's code, design and branding belong to us or our licensors. Third-party software and models remain subject to their own licences. You may use the material you create with Selv for your own purposes, subject to the rights of others in any source material.

We may use feedback you send us to improve Selv without an obligation to compensate or credit you. This does not give us ownership of your personal memory or other content.

10. Warranties and liability

To the extent permitted by law, Selv is provided as available, without a guarantee that it will be uninterrupted, error-free or compatible with every system. Keep backups of content you need to preserve. Nothing in these Terms excludes mandatory rights concerning faulty, misdescribed or undelivered software.

To the extent permitted by law, we are not liable for indirect or consequential losses arising from use of Selv. Our total liability under these Terms is limited to the greater of the amount you paid for Selv in the 12 months before the claim or CHF 100.

These limitations do not apply where liability cannot lawfully be excluded or limited, including fraud, intentional misconduct, gross negligence, death or personal injury, or mandatory consumer rights.

11. Ending use and licence termination

You may stop using Selv at any time. Uninstalling the application does not request a refund and may leave local data or backups on your device.

We may revoke a paid licence after a refund or reversed payment, or for a material breach of these Terms. Where a breach can be remedied, we will give reasonable notice and an opportunity to remedy it, unless immediate action is legally required or necessary to address fraud or unauthorised access. We do not revoke a properly purchased licence merely because its update window ends or we stop developing Selv.

Ending a licence does not transfer ownership of your content to us. Terms concerning accrued obligations, intellectual property, liability and disputes continue where relevant.

12. Changes and governing law

We may update these Terms and will publish the effective date and give notice of material changes. Changes do not retroactively remove a purchased perpetual licence or its included update window. If a change requires your consent under applicable law, we will obtain it.

These Terms are governed by Swiss law. The courts of the Canton of Zug, Switzerland, have jurisdiction except where mandatory law gives you other rights, including the right to bring a consumer claim where you live. Paddle's terms govern disputes about its payment services.

If a provision is unenforceable, the remaining provisions continue to apply. These Terms govern your use of Selv, together with any specific written purchase commitment we made to you. They do not remove rights under an earlier purchase.
