These Terms of Service ("Terms") govern your access to and use of the selv application and related services ("Service"), provided by Louis Hein / selv ("we", "our", "us"). By downloading, installing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement. If you are under 18, you represent that you have obtained consent from a parent or legal guardian.

Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the selv application on devices you own or control, solely for your personal, non-commercial purposes.

This license does not include the right to:

• Sublicense, sell, resell, or redistribute the Service or any portion of it.

• Reverse-engineer, decompile, or disassemble the Service.

• Use the Service to develop a competing product or service.

• Remove or obscure any proprietary notices or labels.

The Free tier is provided at no charge and includes encrypted journaling, private local search, on-device protection, limited activity history, and a limited number of daily AI queries as described in the current feature listing on our website. Free tier features may be modified or reduced over time with reasonable notice.

The Pro subscription is billed at the then-current monthly or annual rate as displayed at the time of purchase. It includes unlimited on-device AI chat, full capture functionality, analytics dashboards, and encrypted local history. Subscription fees are charged in advance on a recurring basis. You may cancel at any time; cancellation takes effect at the end of the current billing period.

The Sovereign subscription includes everything in Pro, plus priority support, early access to advanced features, and first access to new models and capabilities. It is billed at the then-current monthly or annual rate as displayed at the time of purchase.

Certain early supporters may have purchased or been granted lifetime access ("Founding Member" tier) under a one-time payment arrangement. Founding Members receive:

• Perpetual access to all features available in the Pro tier at the time of their purchase.

• Access to future Pro-equivalent features as they are released, for the lifetime of the Service.

• No recurring subscription fees for Pro-tier functionality.

Founding Member status is personal and non-transferable. It does not automatically include features beyond the Pro tier (e.g., Sovereign-exclusive features) unless separately granted in writing. We reserve the right to introduce new tiers above the Pro tier at any time; Founding Member access does not entitle holders to those tiers without additional purchase.

Active subscribers (Pro and Sovereign) receive all updates, improvements, and new features included in their tier for as long as their subscription remains active. Updates are delivered automatically or on demand via standard application update mechanisms. Subscription cancellation terminates entitlement to future updates.

Founding Members are entitled to receive all updates to Pro-tier features for the lifetime of the Service, at no additional charge. "Lifetime of the Service" means for as long as we continue to offer and maintain the selv application in substantially its current form. If we discontinue the Service entirely, Founding Member entitlement ends; we will provide at least 90 days' notice before discontinuation.

Free tier users receive updates at our discretion. We may restrict or remove features from the Free tier with 30 days' notice.

Subscriptions are processed through Apple's App Store or other payment processors as applicable. Payments are subject to the payment processor's terms. We do not directly handle or store your payment information. Prices are stated exclusive of applicable taxes unless otherwise indicated. You are responsible for all taxes applicable to your purchase.

Subscription renewals occur automatically unless cancelled before the renewal date. Refunds are handled in accordance with the applicable App Store policy or, where we process payments directly, within 14 days of purchase for digital goods not yet used.

All content, code, design, branding, and technology comprising the Service are owned by us or our licensors and are protected by copyright, trademark, and other applicable laws. These Terms do not transfer any ownership rights to you.

Any feedback, suggestions, or ideas you submit regarding the Service may be used by us without restriction, compensation, or attribution to you.

Your use of the Service is also governed by our Privacy Policy, available at selv.io/privacy-policy, which is incorporated into these Terms by reference. The Service is designed to process and store personal data locally on your device. We do not collect, transmit, or have access to your personal notes, memories, or captured content unless you explicitly enable optional cloud features.

You agree not to use the Service to:

• Violate any applicable law or regulation.

• Infringe on the rights of others, including intellectual property rights.

• Transmit harmful, unlawful, harassing, or objectionable content.

• Attempt to gain unauthorized access to systems or data.

• Interfere with or disrupt the integrity or performance of the Service.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE AND OUR OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING UNDER OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) CHF 100.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITY. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

You agree to indemnify, defend, and hold harmless us and our officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice, if we believe you have violated these Terms. Upon termination, your license to use the Service immediately ends. Provisions that by their nature should survive termination will survive, including Sections 6, 9, 10, 11, 13, and 14.

You may terminate your account at any time by uninstalling the application and, where applicable, cancelling your subscription.

These Terms are governed by the laws of Switzerland, without regard to its conflict of law provisions. Any dispute arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of the Canton of Zug, Switzerland. If you are a consumer in the EU, you may also have the right to bring proceedings in the courts of your country of residence.

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms with a new "Last updated" date and, where appropriate, by notifying you through the application or by email. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

These Terms constitute the entire agreement between you and us regarding the Service and supersede all prior agreements or understandings. If any provision is found unenforceable, the remaining provisions will remain in full force. Our failure to enforce any provision does not constitute a waiver of our right to do so in the future.
